Today's People's Vote briefing:
Some people think it’s impossible to get a People’s Vote because Theresa May has ruled one out. This is not so. MPs will have many ways to give the people a final say at the end of the Brexit talks if that’s what they want, according to a report written by Lord Kerr, the former civil servant who helped write Article 50, with input from a range of constitutional and legal experts, as well as politicians in the UK and Europe.

If MPs decide to give voters the final say, the report recommends it should be a binary choice between staying in the EU and whatever the government is proposing. If there’s no deal, the choice should be between staying and leaving the EU without a deal. If there’s a deal, it should be a choice between staying and leaving with the deal May has negotiated.

The report, which has been written for the People’s Vote campaign, does not rule out entirely a referendum with three options if it could command a majority in Parliament. But it says that, for reasons of simplicity, speed and clarity, as well as past experience, it is unlikely such a proposal would prevail.

The report, entitled The Roadmap to a People’s Vote, sets out six plausible routes to get such a vote:
  • If there’s a deal, MPs could amend the Parliamentary motion needed to back it, requiring the deal to be subject to a People’s Vote.
  • If MPs reject a deal or there’s no deal by January 21, the government has to present alternative plans to Parliament. MPs could then amend the motion approving those plans, making them subject to a People’s Vote.
  • Even if MPs support the motion to back the government’s deal, they could amend the legislation implementing it, making it conditional on approval by a People’s Vote.
  • The prime minister herself could decide to put her deal to the people either because MPs have rejected it or because she fears they will.
  • May could also decide to ask the people what to do if she is unable to secure a deal.
  • If there’s a snap election in the next few months, MPs could then legislate for a People’s Vote.
The report says yet more options may open up for MPs to force a People’s Vote, as events and possible chaos unfold. If a People’s Vote is not granted by Parliament, it will not be due to procedural impediments or a lack of time, but because MPs have chosen not to take these opportunities. After all, it is Parliament not the prime minister who is sovereign - and May is being undemocratic to suggest she can tell MPs what to do.

No real progress on Irish border

Theresa May will get 10 minutes in Salzburg this evening to pitch her Chequers proposal to 27 other EU leaders, in the hope of going over the head of the EU’s chief negotiator Michel Barnier. She’s very unlikely to pull this off. The 27 give Barnier his orders, and Irish PM Leo Varadkar has already said he doesn’t expect “any change to the EU’s position or any change to our negotiating guidelines”.

So what about Northern Ireland? Barnier has now given more details of his offer to “de-dramatise” the Irish border. It would involve checking goods which cross from Great Britain to Northern Ireland at “company premises or at the markets”. But that still leaves Northern Ireland in a different regulatory regime to the rest of the UK - something the DUP, who prop up May in Parliament, refuse to accept. May looks set to return from Austria empty handed.

Car chaos - even before Brexit

Brexit is already wreaking havoc in the UK’s car industry. BMWannounced yesterday it will be shutting its Mini factory in Oxford for at least a month after “Brexit day” next March, in order to protect its operations from a potential no-deal crash out of the EU. This comes hot on the heels of Jaguar Land Roverannouncing a cut back in production, moving the 3,000 workers at its Solihull plant to a three-day week, due to “continuing headwinds” for the car industry. Honda is also warning a no-deal Brexit would cost it “tens of millions” of pounds. All this before we’ve even left the EU. Then the damage caused to car companies’ supply chains could prove even more chaotic.

Choking on Brexit

Air pollution could be responsible for 60,000 cases of dementia in the UK, with a 40% increased risk if you live in a dirty area. The story leads both The Times and Mail today. Air pollution is a prime example of an issue which the EU is trying to clamp down on while the UK is being slow to act. In May the EU took the UK (and five other member states) to court for repeatedly breaching legal levels of pollution, saying the government had blown several “last chances” to make amends. The EU can force change from a UK government either unwilling or too distracted to clean up our air. No such protection will be available after Brexit.

People's Vote briefing:
Is Theresa May (Queen of the Brexit U-turn) about to make another flip-flop? She told other EU leaders last night at a dinner in Salzburg that it was a simple matter of her deal or no deal. There will be no extension to Article 50, there will be no People’s Vote and the EU’s proposals for customs checks between Northern Ireland and Great Britain are “not credible”; no British prime minister could accept such a division of sovereign territory.

However, the FT reports that May’s objections to the EU’s Irish “backstop” have been deliberately phrased to allow a plan for regulatory checks in the Irish sea, keeping Northern Ireland in the single market for goods no matter what deal is struck. TheIndependent has a similar story. Doesn’t that amount to a division of our sovereign territory? Quite how the government will square that with its DUP partners is a mystery.

The EU is certainly expecting further concessions from May - not just on the Irish border. Donald Tusk, president of the EU council, said the Chequers plan needed to be “reworked and further negotiated” - and the president of the Council is supposed to be the “good cop” in this negotiation. Jean-Claude Juncker, the bad cop, was even blunter. The European Commission president said a deal is still “far away”.

If May is preparing to make a u-turn over the Irish backstop, how long will it be before she flip-flops over her other pronouncements last night, in particular her statement that there won’t be a People’s Vote? Remember how she used to say there would be no new election - and then she called one? If she comes back with a miserable deal that MPs don’t like - or no deal at all - she may be forced to ask the people what they want.

Indeed, it’s increasingly clear Theresa May has a mountain to climb to persuade MPs to back any deal she produces. David Davis, the former Brexit secretary, will say the prime minister is a “bigger menace to British voters” than the EU and that her Chequers plan is “devoid of democracy altogether”. Meanwhile, Mike Penning, who used to be a close ally of May, believes the Chequers plan is “dead as a dodo”, and the prime minister is “deluded” if she thinks she can “blackmail” her MPs into supporting it.

Minister says People’s Vote is possible

Meanwhile, treasury minister Mel Stride has let the cat out of the bag: if the House of Commons votes down the prime minister’s Chequers proposal, Theresa May may be forced to let the people decide between a catastrophic no deal Brexit and remaining within the EU. While the message was supposed to serve as a warning to the hard-Brexit headbangers within the Conservative party, it’s a big win for the People’s Vote campaign. It gives lie to May’s statement that the only choices are her deal and no deal.

Following the rejection of her Chequers proposals in Salzburg, Theresa May has only dreadful options - unless, that is, she becomes a late convert to a People’s Vote.

The prime minister could press on forlornly with her unloved scheme. That was her robotic response yesterday after the EU rejected her bureaucratic plan for customs and told her that only staying in bits of the single market “will not work, not least because it is undermining the single market".

But pressing on regardless is hopeless. The EU says it won’t even call a previously expected summit in November to wrap up a deal unless there are the outlines of one by the planned October summit. If the prime minister continues to insist it is Chequers or bust, she will be heading for the abyss. Even if she wanted that - and she almost certainly doesn’t - Parliament would probably find a way to stop her doing anything so crazy.

Another option would be for May to offer the EU more concessions. While railing against the bloc’s plans to keep the Irish border open, there are signs that she is preparing to do just that. The idea seems to be to say no to customs checks in the Irish Sea but yes to regulatory checks - whatever that means.

The snag is that such a convoluted scheme is unlikely to please anybody. The EU would say it wouldn’t go far enough; the DUP, which props up May’s government, would freak out because it would put a dividing line between Northern Ireland and Great Britain.

What’s more, to get a deal, the prime minister will have to do more than compromise on the Irish border. The core of Chequers is to stay in the single market for goods but not services or people. The EU won’t wear that. But it is hard to see May agreeing to stay fully in the single market, as that’s contrary to last year’s Conservative manifesto and would be anathema to many of her MPs.

It’s possible she might push for a “blindfold” Brexit where we leave the EU with many of the key things fudged. Before Salzburg, there was a high risk that the EU would play along with such a dishonest game to keep the British people in the dark about what Brexit means until it was too late.

But the French president’s desire for clarity rather than fudge has prevailed - at least for now. Emmanuel Macron said yesterday: "Brexit has shown us one thing - and I fully respect British sovereignty in saying this - it has demonstrated that those who said you can easily do without Europe, that it will all go very well, that it is easy and there will be lots of money, are liars.”

The prime minister’s other main option is to cave into pressure from hardline Brexiters in her party such as Boris Johnson and Jacob Rees-Mogg and “chuck Chequers”. She could then embrace their proposal for a free trade deal with the EU on the lines of the one Canada has with the bloc. Cabinet ministers including Sajid Javid, Andrea Leadsom, Penny Mordaunt, and Esther McVey will push her to do that according to the Times.

The problem is that the EU won’t give us a Canada-style deal unless we first agree a divorce deal - and it won’t agree a divorce deal unless we first agree arrangements to keep the Irish border open - and the DUP will go bananas if the government says yes to border checks in the Irish Sea.

So doing what the hardliners want would amount to crashing out of the EU with no deal at all. They may be happy to risk that. And you can already see the Brexit press ratcheting up the blame game. The Express says the EU is “vengeful”, the Sun describes the EU as “dirty rats” who have ambushed the prime minister.

But this is nonsense. Chequers was an unworkable plan from the start. May’s own errors have led to yesterday’s diplomatic humiliation, as these excellent pieces in The Times and Telegraphshow.

If the prime minister can’t figure out what to do, she could fall on her sword or wait for her colleagues to stab her in the back. Either way, it would then be up to some new prime minister to deal with the mess.

But even that wouldn’t be a solution. The only sensible option is to ask the people whether they still want this train-wreck of a Brexit.

Labour could win big by backing People’s Vote

Two new polls show that the Labour party stands to make huge gains if it backs a People’s Vote. The first poll, conducted by YouGov, asked more than 10,000 people whether they’d be more likely to vote for the party if it called for a People’s Vote. And by a huge margin, they were. YouGov calculated that adopting the policy would win the party 1.5 million votes across the country. Polling expert Peter Kellner said the findings left “no doubt that by backing a popular vote on Brexit, the party would end up making significant gains in votes and seats”.

Country unprepared for “no deal”

With crashing out of the EU without a deal very much back on the menu, it’s worth checking in on the government’s preparations. Adam Marshall, director general of the British Chamber of Commerce, says businesses aren’t ready for a no deal Brexit - and neither is the government, describing the government’s statements as “100 pages of waffle”. Meanwhile, industry body EEF says more than 80% of UK manufacturers are unprepared for a no-deal Brexit, while one in six think it would make their business “untenable”.

What say you, coffee? Are you impervious to evidence and facts? Instead of immigration myths we now have facts. But will we act upon them?
In other words, the issue that was so brutally exploited by Leave campaigners during the referendum, the issue at the heart of the greatest political folly of our age, the issue that has bitterly and profoundly divided the nation and been used to induce us to turn our backs on our main training partners and flounce out of the richest trading bloc in the world, was – after all – founded on a fantasy, one generated over decades by rightwing tabloids and brought into vivid focus in 2016 by the algorithms of the Leave campaigners.

With the evidence now in and the claims that had been plastered over their pages disproved, what has been the reaction of those same newspapers to this vast infusion of official data and analysis? Silence. In time, they will cherrypick from the report and ignore the authors’ injunction not to see things in isolation, because immigration is no longer about evidence, the economy or national wellbeing. For some, it has become a belief system, impervious to evidence.

The 5 options scored as follows: Canada 22%, Chequers 11%, No deal 19%, Remain 16%, and Norway 11%, while 20% were Don't Know. So just a mess, and, given that No Deal versus Remain is the most likely choice in a possible second referendum, this gives Remain clear the advantage if the Soft Brexiteers of the Norway option, and maybe too those of the softish Chequers option, are added in!

That's hilarious, coffee. The 'deal' the Tories have is the Chequers' deal (which it cannot get) - that's the only one there is at the moment - and less than one in five support it. Only slightly more want a Canadian style deal - but I wonder how many know what that entails? But there is no Canada deal on the table, is there, coffee?

Good morning Alan,

The UK seems to be stuck in a surreal no-deal Brexit paradox: more and more people urge against crashing out of the EU with no deal, and yet the prospect seems to creep ever closer.

At the heart of the problem is Theresa May’s resurrection of the catchphrase “no deal is better than a bad deal”. Nowadays she adds a bit more context, explaining that for her a bad deal would be “something that broke up the United Kingdom”. That means anything that treats Northern Ireland differently to the rest of the UK - either a customs border down the Irish Sea or the kind of regulatory divergence proposed by the EU to “de-dramatise” the border issue.

What makes May’s hardline rhetoric so troubling is that there is no solution in sight to the Irish border question. A group of Cabinet ministers - including Dominic Raab, Jeremy Hunt, Michael Gove and Sajid Javid - are all now pushing against no deal, according to reports in the Times. At the same time they’re pushing for a Canada-style trade deal, pitching it as a “Plan B” after agreeing to back May’s dead Chequers deal earlier this week. Again, the problem with “Canada” is it has no Irish solution.

Jeremy Corbyn also vowed to resist a no-deal Brexit in his Labour party conference speech yesterday. He called it a “national disaster”. But his party’s ongoing campaigning for a new general election has spooked our EU partners, who fear Labour will attempt to overthrow the government at any cost, according to the Guardian. As a result, EU officials are contemplating emergency mini-deals to make sure that crucial activities such as flights and movement of medicines can continue if no deal happens.

Meanwhile the National Farmers Union has warned that no deal could mean UK farming exports to the EU would simply stop for six months while we try to get approval as an EU food supplier. And in a sign that the government takes a potential no-deal food crisis seriously, it has appointed a brand new “minister for food supplies”.

Nobody voted for anything so catastrophic, and you’d hope common sense would kick in at some point. But no solution seems in sight. That’s why a People’s Vote is essential to give the public a chance to say: “Stop the madness.”

The specially one-sided relationship

The UK-US relationship looked increasingly unbalanced in New York this week. At the UN General Assembly, Theresa May shied away from criticising Donald Trump for trying to tear up the Iran nuclear deal. While the Swedish foreign minister and French president condemned the move, May praised Trump for his negotiations with North Korean leader Kim Jong-un.

Meanwhile a meeting between Trump and May yielded an enthusiastic briefing from Downing Street, hailing Brexit as a “wonderful opportunity to strike a big and ambitious UK-US Free Trade Agreement”. A White House report, however, made no mention of such a trade deal. At the same time, US companieshave been asking May “how bad can things get” on Brexit? Their minds are clearly on damage limitation rather than wonderful opportunities. It looks increasingly like the UK is pinning its post-Brexit future on a lucrative US partnership that doesn’t exist.

Budget date headache

Philip Hammond announced the date of his 2018 Budget yesterday: October 29. It’s an earlier date than usual, to avoid clashing with what optimists are billing as the final stages in the Brexit negotiations, at an EU summit on November 17/18. The FT suspects he wants to reassure financial markets before the perilous endgame.

The Budget is therefore sandwiched between two high-stakes EU summits, with an earlier meeting on October 18. If the October summit doesn’t make progress, EU leaders have suggested the November meeting won’t happen as planned anyway. And if Brexit negotiations don’t go smoothly, how much of what the chancellor promises can actually be delivered in the ensuing turmoil? It’s another example of Brexit overshadowing the basic functioning of government, at a time when we need stable leadership to bring our divided country back together.
